Welcome to Skidattl, an app developed by Lyv Technologies, Inc. (“we,” “us,” or “our'').

1. Acceptance of Terms

By accessing or using Skidattl (the "App"), you agree to comply with and be bound by these Terms of Service (the “Terms”) and associated Privacy Policy. If you do not agree to these Terms, please do not use the App.

2. User Profiles and Content

You may create a profile on the App, which may include biographical information and photos. You are responsible for the accuracy and appropriateness of the content you provide.

You may upload photos to your profile or share them with other Users. By doing so, you grant Skidattl a non-exclusive, worldwide, royalty-free license to use, reproduce, and distribute the photos within the App.

3. Location Sharing

The App allows you to share your current location with other Users. By using this feature, you consent to sharing your location information with others.

You may also share your future location with other Users. This information will be visible to those with whom you choose to share it.

We are not responsible for the accuracy or consequences of location sharing. Use this feature responsibly.

4. Notifications

Users may receive notifications from other Users. Notifications can be managed with notification settings on your device.

We reserve the right to send important service-related notifications.

5. User Conduct

You agree not to engage in any activity that disrupts or interferes with the App's functionality.

Users are strictly prohibited from creating, sharing, or promoting:

Hate Speech: Any content that promotes violence or hatred against individuals or groups based on attributes such as race, religion, ethnic origin, sexual orientation, ability, or gender.

Harassment and Bullying: Targeting individuals or groups with content intended to intimidate, degrade, abuse, or create a hostile environment.

Graphic Violence: Content that glorifies violence or promotes self-harm, including, but not limited to, images or descriptions of graphic injuries or death.

Nudity and Sexual Content: Sharing or distributing pornographic content or any content that exploits individuals in a sexual manner.

Impersonation: Creating a profile pretending to be someone else or misrepresenting oneself in a misleading or deceptive manner.

Private Information: Sharing or distributing someone else's private information without their explicit consent, such as addresses, phone numbers, email addresses, or other personal details.

Illegal Activities: Content that promotes or glorifies illegal activities, including the sale or use of drugs, theft, fraud, or other criminal activities.

Misinformation: Sharing or promoting false information that can cause harm or mislead users, particularly related to sensitive topics like health or elections.

Spam: Unsolicited or unauthorized advertising, promotional materials, junk mail, or any other form of solicitation.

Malicious Software: Distributing viruses, malware, or any other malicious code intended to harm or exploit any device, service, or network.

Terrorist Content: Content that promotes terrorist activities, including recruitment, or that celebrates terrorist attacks.

Self-Destructive Behavior: Promoting or glorifying self-destructive behaviors, including substance abuse, eating disorders, or self-harm.

We reserve the right to modify or expand this list at any time. Users found in violation of these guidelines may be subject to penalties including, but not limited to, account suspension or removal. We reserve the right to report violations to appropriate authorities.

6. Privacy and Data Collection

Your use of the App is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information, including location data. By using the App, you consent to the practices described in the Privacy Policy.

7. Termination

We may terminate your access to the App at any time without notice if you violate these Terms. Upon termination, your right to use the App will cease immediately.

8. Limitation of Liability

You use the App at your own risk. We provide no warranties or guarantees regarding the App's availability, reliability, or accuracy.

In no event shall we be liable for any direct, indirect, incidental, consequential, or special damages arising out of, or in connection with your use of the App.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website, and it is your responsibility to review them periodically. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

11. Content Moderation

We reserve the right to monitor and moderate User-generated content within the App.

You agree that we may, at our sole discretion, remove or edit any content that violates these Terms, or is deemed inappropriate, offensive, or unlawful.

We are not obligated to notify you before taking action to remove or edit content.

While we make reasonable efforts to ensure the enforcement of these guidelines, we are not liable for any content posted by Users that may violate these Terms or any applicable laws.

12. User Bans

We reserve the right to suspend or permanently ban Users who violate these Terms of Service or engage in prohibited activities.

We may exercise this right at our sole discretion, with or without prior notice.

If your account is banned, you may lose access to all features of the App, and any subscriptions or purchases may be forfeited without refund.

You agree not to attempt to re-register or use the App under a different account if you have been banned.

Introduction

Welcome to Skidattl, developed by Lyv Technologies, Inc. (“we,” “us,” or “our''). We are committed to protecting your privacy and ensuring the security of your personal information. We acknowledge the importance of ethically balancing protecting the privacy and the security of our Users.

This Privacy Policy outlines how we collect, use, disclose, and most importantly, safeguard your data when you use our mobile application and web services. By using Skidattl, you agree to the practices described in this Privacy Policy.

Information We Collect

Information You Provide

We may collect the following information:

Personal Information:

Such as your name, email address, and your age range when you first create your account. This helps us to verify that you are you, and that your age meets Skidattl’s Terms of Service.

We may also use this information to communicate with you periodically by email about changes with your account, and optional surveys regarding your impressions of, and experiences with the app.

User-Generated Content:

This includes all text you input while interacting with the app, including chat. It also includes photos uploaded to the app, and posts that you share within the app. Skidattl gives you creative freedom (within the parameters of the Terms of Service) as you create and interact within the app.

For example, when you write details in a Beacon you create, or upload the perfect photo to represent your Beacon, or share a message or Beacon in chat, we collect that data so we can share it with your intended audience. Collecting this information also allows us to provide security as noted in the Terms of Service.

When User-generated content is deleted from the app, it is not retained by Skidattl.

Location Data:

Such as your current location and last known location. Skidattl is all about finding the fun around you, but if we don’t know where you are, that’s a little tough to do. Using Skidattl means consenting to sharing your location while using the app.

User Interactions:

We collect data on how you interact with the app. We’re interested to know how you use the app, so we can provide you with the best experience each time you use Skidattl; for example, prioritizing Beacons that you may have viewed previously.

User Relationships:

For reasons similar to those listed above, we collect information about how Users interact with one another, including liking, following, messaging, commenting, and sharing.

Information Automatically Collected

We may collect certain information automatically.

Device Information:

This type of data includes the User’s device type, operating system, and unique device identifiers. When we know the hardware and software you’re using, we can optimize the performance of Skidattl on your device.

Usage Data:

Skidattl tailors your specific app to personalize your experience. When we know what pages you view, what actions you take, and other metrics of your engagement, we get even better at showing you where the fun is, personalized for your preferences.


Artificial Intelligence

We may use certain collected information to develop, train, or enhance artificial intelligence or machine learning models.

“Usage Data and Customer Content may be used to develop, train, or enhance artificial intelligence or machine learning models that are part of Provider’s products and services, including third-party components of the Product, and Customer authorizes Provider to process its Usage Data and Customer Content for such purposes. However, (a) Usage Data and Customer Content must be aggregated before it can be used for these purposes, and (b) Provider will use commercially reasonable efforts consistent with industry standard technology to de-identify Usage Data and Customer Content before such use. Nothing in this section will reduce or limit Provider’s obligations regarding Personal Data that may be contained in Usage Data or Customer Content under Applicable Data Protection Laws. Due to the nature of artificial intelligence and machine learning, information generated by these features may be incorrect or inaccurate. Product features that include artificial intelligence or machine learning models are not human and are not a substitute for human oversight.”

Cookies and Tracking

Mmm cookies; so soft and delicious. Just kidding, these aren’t the chocolate chip kind of cookies.

This type of cookie allows us to add to your convenience & experience while using the app. For example, remembering that you’ve signed in previously so you aren’t required to enter your Username and password each time you open the app.

Skidattl also uses tracking technologies related to a User’s geographic locations via GPS on their device. Essentially, we’re interested to see if you visit the Beacons that you’ve viewed, and to offer navigation features in the app..

How We Use Your Information

As described in the examples in the previous section, there are a variety of ways we make the User experience better using the information we collect from you. Here are a few more ways your information may be used:

Personalizing your experience and delivering content tailored to your interests and location.

Developing algorithms to recommend relevant Beacons, points of interest, and Users to follow.

Enhancing User experience by curating content based on location, interests, and connections.

User Consent

Consent is paramount. We obtain User consent for data collection and processing during the app’s initial setup when you create your account.

Users must certify that they are above the age of 18 to use the app. This certification is made as part of a User’s initial sign-up. At this time, minors are not permitted to use Skidattl.

Data Security

We take protecting the security of your information very seriously. Skidattl uses industry-standard security measures to prevent data breaches. Strong passwords are required from Users, and Users are verified through email.

Data Retention

A User’s data is retained as long as they have an active Skidattl account in order to curate suggestions based on User interactions and engagement. When a User’s account is deleted, their data, including all Beacons and uploaded photos, are also permanently deleted. If a User deletes User-Generated data, that information is not retained by the app.

If Skidattl were to be discontinued, Users will be given the option to migrate their data, primarily Beacons and photos, to another database, or to have their data permanently deleted. In that instance, communication regarding a discontinuation would be made with the User via email.

User Rights

Users can request removal of their data from the database, which will be achieved by permanently deleting their account and all of their data.

To exercise your rights, you can contact Skidattl Support using links provided in-app and in email correspondence.

Third-Party Services

Skidattl does not currently integrate with any third-party apps. If Users choose to use the Navigate feature in-app, they will be redirected to the default map app on their device, which may collect User data outside the control of Skidattl.

Beacon creators are able to link out to third-party sites, like a call to action button linking to a menu on their website, or a third-party site to purchase tickets, merchandise, etc. If Users choose to select any of these links, they will be redirected in a new tab on their default browser, which may collect User data outside the control of Skidattl.

Updates and Communication

Periodically, Skidattl will provide updates to continually improve the app. We will provide notice of material changes to our privacy policy through our Website. Users can also contact us via links in the app or by email for privacy-related concerns.

Children’s Privacy

Skidattl may only be used only by Users over the age of 18. During initial sign-up and User verification, Users are required to certify that they are over the age of 18. Our app does not target or collect data from children.
